Local Authorities have the powers to protect important trees through the use of a Tree Preservation Order (TPO); this means that in most instances you will need to apply for consent to prune or fell the tree. In Conservation Areas all trees over a certain size also receive provisional protection and in this instance you must give six weeks notice before undertaking works to a tree.

 

We have an in-depth knowledge of the legislation relating to trees in these situations and can advise our clients accordingly. We can give advice as to what works may be appropriate in any given situation and can submit any applications or notifications, which may be necessary. These will include all the information necessary for the Local Authority to determine the application and for an appeal to be made should consent be unreasonably withheld.

 

Where a TPO is placed on a tree that is not of sufficient quality and value to warrant such protection we are also able to assist by preparing a robust objection to the Order.
